LICENSING, TERMS OF USE 

You are purchasing machine embroidery designs. These are digital files and NOT the finished product. You must have an embroidery machine in order to use these designs.  You must download the file to your computer, unzip the files and have a way to transfer the design/s to your embroidery machine. All design formats are included in a single zip file.  Our designs come in the following formats only:  DST, EXP, HUS, JEF, PES, VIP, VP3 and XXX. In some instances, a format may be excluded from the file due to hoop size restrictions. This will be mentioned on the product page. 

Our designs may NOT be purchased and brought to someone else to put on a product. They are licensed ONLY to the purchaser of the designs.  If you would like something stitched onto a product, have the person doing the embroidery purchase the files.

 

YOUR ACCOUNT, DOWNLOADING AND STORING YOUR DESIGNS

You may not share your login to our website with another individual. As a convenience to our customers, we have provided a venue for you to view your purchases.  It is highly recommended that you download your designs upon purchase. Please remember that we are selling digital machine embroidery designs and NOT a cloud storage service. Embroidery Weekly is NOT responsible for lost designs if you have not downloaded them. 

A download limit of 5 downloads per order will be applied. This means you can download the digital product you bought up to 5 times. Thereafter the design (digital product) will have to be purchased again in order to continue downloading copies. 

Download links expire after 30 days. This means that you have 30 days from date of purchase to download your designs (digital product). Thereafter the design (digital product) will have to be purchased again in order to continue downloading copies.

BACK UP YOUR DESIGNS to a USB or Hard Drive. If you backup your designs, you will not need to continuously keep downloading the designs. Also, you will have them safely stored should your computer crash. Computer crashes do happen. And lastly, having your purchased designs stored safely to a usb or hard drive, makes it easier to keep record of your designs.

 

DESIGN SHARING

Our digitized embroidery designs, either purchased or free, MAY NOT be sold, traded shared, given away or included in any design set. This includes purchasing with the intent to copy and share with your family and friends. You may not use ANY portion of our design as a basis to create a new design and call it your own.

Many hours are spent in creating these designs / patterns, to bring you unique, high-quality designs at extremely affordable prices. 

You may NOT get together with your friend or relative to "go in on" designs or make a purchase together to achieve a tiered discount price. This is sharing and is strictly prohibited within our terms of use. We work hard to keep our prices extremely low to make our designs affordable to everyone. Please purchase your own design set.

We reserve the right to immediately and without notice terminate repeat and future downloading abilities to any account holder who is known to be sharing designs. ALL design downloads will be terminated. Our designs are available for instant download upon purchase. We are not required to provide indefinite and unlimited downloads.

By purchasing our designs, you are purchasing a LICENSE to use them. Only the actual purchaser of the designs holds this license. This license is NON-transferable. You may not at any time, pass the files to anyone else for any reason.

Our designs are copyright protected. You are purchasing a license to use the design. The design remains the property of Embroidery Weekly. 

 

USING OUR DESIGNS ON ITEMS FOR SALE

We encourage the use of our designs to be stitched on items you sell!  Our designs MAY be stitched on items to be sold as long as only the individual purchaser sews the designs, there is no limit to the number of times you may stitch them on items for sale. Designs used on items for sale must be purchased.  FREEBIES: You may NOT use our free designs on items for sale. You must purchase the designs if you are going to make a profit.

While you may stitch the designs on items to be sold, including iron-on applique patches, you may not claim to be the creator/designer of the designs themselves. 

In the event of a joint business where there are two or more embroiderers, a license MUST be purchased for *each person*. Again, our designs are licensed ONLY to ONE individual. Each embroiderer must purchase their own copy. In the event of a business partnership, each individual must have purchased their own copies. This is no different than other commercial use terms such as "2 user license" "3 user license" etc. Thank you for complying with our terms.

WHAT YOU CAN DO WITH OUR DESIGNS

• You may change the colors, add wording or lettering to personalize the design
• You may stitch the designs onto items for sale
• You can only sell the finished product
  

WHAT YOU MAY NOT DO WITH OUR DESIGNS

• You may not resell, share the design or share the download links.
• You may not sell an edited design.
• Our designs CANNOT be printed with the intent to use for hand embroidery or SVGs.
• You may not use our designs for embroidery classes without written consent from Embroidery Weekly.
• You may not use our designs in a manner that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, deceptive, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, obscene, threatening, profane, or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, or is otherwise objectionable.

 

EMBROIDERY EDITING SOFTWARE

Our designs are manually digitized for efficiency, stitch count, and sequence. ALL designs are tested prior to availability, and quality is guaranteed in the files and sizes that we provide.

We are UNABLE to guarantee a design that has been resized, edited. merged, or opened in software that may alter the settings of the design (i.e. software programs that color sort or change the Stitch sequence by default, remove overlaps, etc.) If embroidery editing software is used to open, edit, and export a design, it is important that you are proficient with the software. We are unable to provide support should a problem arise due to too many variables in all of the software programs.

 

STITCHING ISSUES WITH OUR DESIGNS

All designs are tested for quality prior to release. If you are having stitching issues related to the digitized file(s) please fill out this Contact Form.  Embroidery Weekly is not liable for items that may be harmed during a stitch out.  If you are stitching onto an expensive item, it is highly recommended that you do a test stitch-out first as results may vary depending on your fabric, stabilizing, hooping etc. Please contact us if you have any issues PRIOR to stitching on a purchased item. We DO NOT provide reimbursement or compensation for damaged embroidery blanks including clothing, bags, towels etc. 

 

REFUNDS, EXCHANGES AND STORE CREDIT

Due to the digital nature of our designs and their ability to be downloaded instantly, ALL SALES ARE FINAL. This includes Gift Card sales. 
If you are experiencing technical problems with your purchased designs, please use this Contact Form to report a problem. We don't anticipate a problem with the files, but sometimes errors occur and we will do everything in our power to fix the designs. If we are unable to fix the designs we will apply the amount spent on the designs, in the form of a Gift Card / store credit, to your account.

THIS SHOPPING CART DOES NOT ALERT FOR DUPLICATE ORDERS. PLEASE ORDER WISELY. NO REFUNDS. However, a store credit or substitution might be considered at the seller's discretion within seven days of purchase. Free designs (such as bonus designs or gift designs etc) and designs in bundles, combos or packs are not eligible.

If you purchased a design set by accident or by mistake, we do not provide a refund.

DO NOT file a dispute with your credit card or PayPal before attempting to reach out for support. Filing a dispute will lock your account until the dispute is settled and we are compensated for the products.

We reserve the right at any time to modify or discontinue a product without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
